What RERA Registration Gives a Plot Buyer
The Real Estate (Regulation and Development) Act, 2016 applies to plotted developments as well as apartments. Key provisions once a project is registered:
| Provision | What it says (summary) | Why it matters |
|---|---|---|
| Section 3 | Projects needing registration must be registered before advertising, marketing, booking or selling | Confirms the project has passed regulatory scrutiny |
| Section 4 | Promoter must disclose approvals, layout, timelines; 70% of buyer money goes to a separate account | Your payments are ring-fenced for the project |
| Section 11 | Promoter must publish project details and quarterly updates on the portal | You can track progress independently |
| Section 13 | No more than 10% advance without a registered agreement for sale | Limits what you pay before a binding contract |
| Section 14 | No changes to sanctioned plans without buyer consent as prescribed | Protects the layout you bought into |
| Section 18 | Refund with interest, or interest for delay, if possession is delayed | Compensation if the date slips |
Summary for general information; not legal advice. Refer to the Act and the MP RERA rules, or a lawyer, for specifics.
Buying While RERA Approval Is Under Process
Interest in a project often starts before registration. You can gather information, shortlist plots and visit the site. Before paying money, though, wait for registration or take legal advice on the risks.
- Do not pay large sums against an expression of interest or “pre-launch” receipt.
- Insist on receipts for every payment in the developer’s name.
- Read the draft agreement for sale and check its possession and refund clauses.
- Track the portal; once registered, compare the approved layout with what you were shown.
See how RERA timelines relate to the expected handover on the possession date page, and follow status changes on the latest updates page.
